what is a reasonable compensation claim for an pain and suffering incurred from a car accident?
I was hit by a guy running a red light and wasn’t seriously injured but expect to be very sore for a couple of weeks. I am an actor and under contract to perform a live show, so taking time off is not an option- it would end my career in this town, so I have to work in pain. Also, I am unable to use painkillers or muscle relaxers due to a history with drug abuse, so the pain is full on. I don’t feel the need to contact an attorney, but feel I should be compensated somewhat for this guy’s negligence.

Why wouldn’t you consult a lawyer? Most auto-accident lawyers work on contingency, meaning they don’t get paid unless you win.
I was involved in an accident also where my car was totalled and I was injured (the airbag went off but I was not severely injured). I had to see a chiropractor for 4 months.
We ended up settling out of court for $12k for injuries plus cost of the car.
There’s no way of knowing what kind of compensation you should be looking at for Pain and Suffering. All insurance companies figure that out differently. You’re best bet is to consult a lawyer. It’s free until you get a settlement and lawyers will generally get you a whopping more money than you alone will do.
One thing you should be aware of is that many insurance claim adjuster don’t consider soft tissue “pain” or “bruising” to be of any acute concern. That’s where a lawyer will help. If you don’t have any broken bones or major injuries, you won’t get much.
Good luck with the show (it must go on!) and I hope you do feel better soon.
Oh please! The only thing an attorney will do is make your claim pend longer and take 1/3 of the $ the insurance company would offer you anyway.
Assuming you have no treatment, really your claim is worth nothing. That’s the indicator of your pain. But some insurance companies, recognizing that you suffered some might give you up to a thousand dollars or so to go away(don’t hold out for 1k though, that’s a pretty high estimate). No treatment-no injury. If you just got checked out probably 500-1,000. It’s not the lotto.
I’d say just go through your insurance and not try to sue. They’ll deal with everything and get you money that you need to help you. It was an accident, plain and simple.
If you, or your family member or friend has been injured in California as a result of someone else’s carelessness, this is a good time to contact experienced injury attorneys in California who can evaluate your case and give you a realistic idea of your chances of winning damages for your case.
Pretty interesting, I want to learn more. Anymore useful information would be great.
I don’t know how these things work in the US but in the UK you can make a claim on a no win no fee basis and always keep 100% of your compensation.
This is because the lawyer (solicitor) will sign a waiver so that if they are not sucessful then they don’t get paid. If they are sucessful and win your compensation claim for you then they will make a claim for their expenses seperately.
