Sometimes those of us who have lived in the United States for their whole life take for granted that things are different in other parts of the world than they are here. The way that the legal system is approached in other countries is a good example of this. In America we know that we can sue just about anybody for anything. All you have to do is turn on a TV and you’ll soon be bombarded by ambulance chasing attorneys encouraging you to give them a call.

Things are different in Europe though. The concept of lawsuits is similar, but there are a few differences. First of all, they don’t call it the same thing that we do here. On the other side of the pond they call it an accident claim. And if you win your claim you get what they call accident compensation. While the nomenclature may be different, these are similar beasts though. Unlike the rather random nature of lawsuits in the states though, these accident claims tend to be less vague than ours. Instead of concentrating on pain, suffering and other abstract things, these accident compensation claims are focused on the victim recouping things like medical costs.

There is a time and a place for everything. That’s one of the old sayings that seem to fit in pretty well with any situation. Another phrase that is commonly throw around that also makes sense in most situations is: “everything in moderation.” These two phrases can be applied to the concept of accident compensation very well.

When is the right time to pursue accident compensation? Well this is one thing that should never be the first course of action a person would take. Unfortunately, many times this is the first course that people want to take though. I guess you could say that we live in a “sue happy” society. And I’m sure it has something to do with the way that legal firms advertise.

This is where the temperance and moderation parts come in. You see if you have been injured because of another party’s liability often things can be worked out between both parties instead of paying lawyers to get involved. Generally people want to do the right thing. And this includes taking responsibility for their actions without having to be forced to via a lawsuit. Of course there is a time and a place where one may need to sue, and that is why these systems are in place.

Whenever you turn on your TV you can almost be assured that at some point in your current TV watching session you will see a commercial for an injury accident lawyer. You know exactly what I’m talking about. They will come on in their fancy suit standing in their fancy office and say something like “if you are injured in a crash, we can get you cash.” Then they’ll show a picture of a bald eagle, bear, lion, tiger or some other aggressive beast so you know that they will be aggressive. And it’s not just on TV either. When you turn on your radio you get the same thing. And then you reach for the yellow pages and who’s on the back cover? The Wolf who is going to fight for you! And of course there are the newspaper ads and billboards and on and on.

I thought that this was a uniquely American phenomenon. After all, where else can you sue a big corporation if you are stupid enough to pour piping hot coffee in your own crotch? Well I guess I was wrong in assuming we only go lawsuit crazy on this side of the pond. I was travelling in Europe last month and I kept seeing ads for accident compensation attorneys. And guess what? The name may be different, but they are the same thing as we have here!

Workers compensation sounds like something that only could have been dreamed up in the good old USA, right? After all, didn’t we invent things like unions? Yea, we’re the good guys here, so we must have come up with something as great as workers compensation! Well this may just surprise you because this type of accident compensation did not start in the USA. We owe our modern view of it to the accident compensation Europe developed a long time ago.

It all started in the days of privateering (yea, that’s the nice way of saying pirates). They developed a system a long time ago that had set rates for various yet common injuries. For example, the loss of an arm was worth roughly 50 weeks of lost wages. That’s not too far off from what a typical settlement would be here in the US today!

Then more recently, but still in the 1880’s a German Chancellor introduced what he dubbed “workers compensation insurance.” This of course was Otto Von Bismark who later had a ship named after him as well as a pastry that we love to sink. And it was this model that led to the creation of other workers compensation insurance in Europe and then eventually right here at home in the USA.

If you get in an accident in the United States which was somebody else’s fault and you get hurt, what do you do? Simple: you grab the yellow pages and look right on the back cover for the heavy hitting injury accident lawyer in your area. Then you sue the pants off of the person who caused you harm.

But what happens if you find yourself in the same situation, but you were in Europe when this happened? Things work differently there. Instead of hiring a lawyer, you would go to a compensation solicitor. And instead of filing a lawsuit you would file what is called an injury compensation claim.

So it doesn’t exactly sound like we are comparing apples and oranges now does it? Well really we are not. The process is basically the same as it is here only they call things by different names. But there is one noteworthy difference. Let’s say you live in England, but get into an accident in Germany. You would think that at some point that you would have to go back to Germany so a judgment could be reached. But because they all work together and play by the same rules, you could take care of your civil obligation without returning to Germany to do so.

In answer to the question posed in the title of this article, the answer is ‘Yes.’ If you or any member of your family are ever hurt by the negligence, greed or carelessness of another person or a business, then I feel that it’s perfectly legitimate and ethical to be compensated for whatever injuries that are inflicted on you. There are people out there who see accident compensation as a chance to get rich, but I’m not one of them. I certainly don’t have a lot of respect for the law firms that specialize in accident compensation and advertise like crazy on television and the Internet because I regard them as ambulance chasers, but I do feel it’s all right to be compensated for injuries if it’s really the other person’s fault. I think the problem now with going after accident compensation is that because so many greedy lowlifes try to get compensated for every little thing, honest people sometimes feel guilty about pursuing accident compensation.

However, they shouldn’t. If someone else’s carelessness or greed causes an injury, then they need to pay for it. I found a great web page that discusses this issue and I totally agreed with the viewpoint of the person who wrote it. Check it out for yourself and see if you think the reasoning presented here has any merit: http://www.accidentconsult.com/articles/showarticles/Compensation/2/Isitethicallyrighttosueforaccidentcompensation.html.

I know that a lot of people think that it’s sleazy to sue a business or individual after being injured by something that the business or person did (or didn’t do), but you really shouldn’t feel bad about pursing injury compensation. Look at it this way, if your injury was caused by some kind of negligence, carelessness, or deliberate action by another entity, whether it’s an individual or a corporation, they are at fault, not you, and you have every right to be compensated for your injuries, and also the time and trouble it costs you.

Take a recent news story for an example. In early January of 2009 a recall of peanut butter products was announced because certain processed foods were found to be tainted with salmonella, something that can make you very sick or even kill you. I was horrified to learn that the same processing plant that was the source of the recall had had earlier problems with salmonella contamination had continued sending out their tainted food products, knowing that their food was unhealthy and might make people sick! In cases like that, I feel people are absolutely justified in suing the company that knowingly markets a tainted or unsafe product. If you’re concerned about the peanut butter recall and want more information about which products might be tainted, then read this web page: http://peanut-butter.legalview.info/.

Andrew Regan inquired:

A few years ago, if someone had triggered them on a stone paved for irregular probably would have just cursed stone offendente and hobbled at home, trying to remember to be more informed of their surroundings in the future. Today that the event is more likely cause delete a compensation claim against the company responsible for stenditura slab for flooring. But because many people use hours to act, where in the past that they would not have done anything except you blame for their misfortune? Some think that Great Britain is never far behind America, which is notorious for seeking compensation for accident whenever the need presents. Once the cataract is open becomes easier so that others do the same thing and stay complaints of their own. But it is wrong to assume that all cases are a result of unnecessary complaints made by people trying to make some money fast and easy. The vast majority of cases of personal injury occurs while a direct result of precautions and appropriate methods that are not adhered to or not followed, itself is in the place of employment or any other location businesses by the general public. In these cases it is always genuine? suggested the idea to? of the â? of? â highly effectively - to consult a solicitor wound to see regardless of whether you have a case worth pursuing. This in no way are adding to the so-called compensation culture, as a genuine complaint will always have a right to be heard. So whether the increase in cases is mainly due to discovering that people have a perfect right to support an accident or a wound, because it is the host of the press around these cases so negative? And why are we apparently seized from the threat of this crop of compensation? Actually selling? t of? the good news doesn many cards. Newspapers thrive on the disaster on faulty information and sensation. Because of this,? t of? of gives you get to hear of cases where a genuine claim for compensation was determined as a result of an accident or a genuine setback. Only heard talk of people who are less than a trustworthy and have simulated the specific complaints or claims for the land of reasons. The main point that surrounds this crop of compensation is to blame. The rule of thumb should be that if someone has a legitimate accident because someone or something? t of? wasnâ of performing up to required levels, then there is every reason to lodge a claim for compensation. However, if the setback is due to negligence on the part of the person who suffers an accident, so there is no reason to seek the help nell'addossare the blame for that incident elsewhere. In short, if there is a real reason to act then you should do so. The fraudulent claims should never be rendered to? but on the other part of that? â was always? t of? hasnâ and the situation varies.

I am an actor and under contract to perform a live show, so taking time off is not an option- it would end my career in this town, so I have to work in pain. Also, I am unable to use painkillers or muscle relaxers due to a history with drug abuse, so the pain is full on. I don’t feel the need to contact an attorney, but feel I should be compensated somewhat for this guy’s negligence.

Written By: circusboys

About the guy/gal that wrote this:

Nicholas Tate inquired:

Machineries is a big part of every trade factory in the UK. They played a great role in maintaining even the garage and courtyards. With all the benefits these machines require is the possible danger to one 's life Machineries if not done properly operated and was able to put any worker at risk. People working for factories that need through a machine should be in good ways and be properly trained on how the machine works exactly. Employers should also give their workers the appropriate gear in the operation of the machine specification. This could include gloves to protect hands, goggles to protect eyes and elements of the security system to protect the feet from the Articles of fall. Most of the injuries that were followed in the past were mainly offensive to the hands and fingers. These events have occurred mainly due lack of protective gear such as gloves protect their hands. Some workers also tend to bring the jewels that are considered taboo in a big machine operating. There were also cases of injuries to the eyes, this happened due to small particles released in a car at high speed or accidental breakage of parts of machines. Other things caused by accidents of machinery is insufficient knowledge of the workers on the proper operation of machinery, lack of experience dealing with it and moreover the shape and inadequate training inadequate. There are some employers of people just to support the needs of quantities. Note especially the cost to pay without considering that the quality and safety are already at risk.
